1. Introduction
These Terms of Service govern the access to and use of the website, platform, products, and services of SocialTrack JSC (“SocialTrack”, “we”, “our”, or “us”).
By accessing or using SocialTrack, customers and users agree to comply with these Terms of Service, the Privacy Policy, and any related agreements or contracts between SocialTrack and the customer.
2. Service Scope
SocialTrack provides a platform and services for social listening, campaign tracking, brand monitoring, competitor benchmarking, reporting, and social data intelligence.
The specific service scope, including campaigns, monitored platforms, monitoring period, report types, number of users, and deliverables, will be specified in the contract, quotation, appendix, or service agreement between SocialTrack and the customer.
3. User Accounts
SocialTrack does not currently allow public self-registration on the website.
Platform accounts are manually created based on contracts, service agreements, or valid customer requests.
Users are responsible for:
- Providing accurate information when required.
- Keeping login credentials confidential.
- Not sharing accounts with unauthorized persons.
- All activities conducted under their accounts.
- Promptly notifying SocialTrack of any unauthorized access or security incident.
SocialTrack reserves the right to suspend or terminate accounts if we detect violations of these Terms, security risks, or misuse of the platform.
4. Customer Data and Campaign Configuration
Customers may provide SocialTrack with information such as keywords, hashtags, source links, owned channels, competitors, tracking requirements, briefs, reference materials, or campaign configuration data.
Customers are responsible for ensuring that the information provided is lawful, accurate, and does not infringe third-party rights.
Customers retain ownership of the data, materials, and inputs they provide. By providing such information, customers authorize SocialTrack to process it as necessary to provide the services.
5. Public Data and Third-Party Content
SocialTrack may collect, display, analyze, or generate reports based on public data and third-party content, including posts, comments, engagement metrics, pages, profiles, groups, channels, websites, news, or digital platforms.
Such content remains subject to the ownership, terms, and policies of the original platforms or content owners. SocialTrack does not claim ownership of third-party content.
The collection and processing of data are conducted for analysis, aggregation, reporting, and information purposes to support customers’ business, communication, marketing, or market research activities.
6. Acceptable Use
Customers and users agree not to use SocialTrack to:
- Violate any law or third-party rights.
- Access, extract, or use data without authorization.
- Copy, resell, distribute, reverse engineer, or exploit the platform without permission.
- Upload malicious code, viruses, or harmful content.
- Interfere with system security, performance, or stability.
- Use data or reports to defame, harass, discriminate, or harm any person or organization.
- Misrepresent or present SocialTrack data in a misleading manner.
7. Reports, Data, and Insights
SocialTrack provides dashboards, analytical data, reports, and insights based on accessible data sources, campaign configuration, processing methods, and operating conditions at the relevant time.
While we strive to provide accurate and useful information, social data may be affected by third-party platform access limitations, algorithm changes, data delays, technical issues, deleted content, restricted accounts, or factors beyond SocialTrack’s reasonable control.
SocialTrack reports and insights are provided for reference, analysis, and decision-support purposes. They should not be considered legal, financial, investment, medical, or mandatory professional advice.
8. Fees and Payment
SocialTrack services are provided under contracts, quotations, order forms, appendices, or separate agreements between SocialTrack and the customer.
SocialTrack does not currently process online payments on the website. Payment is made through contracts, invoices, and bank transfers according to the agreed terms.
Unless otherwise agreed in writing, paid fees are non-refundable once the service has been activated, implemented, or delivered within the agreed scope.
9. Service Availability
SocialTrack makes reasonable efforts to maintain stable and continuous system operation. However, we do not guarantee that the service will always be uninterrupted or error-free.
The service may be temporarily interrupted due to maintenance, upgrades, technical issues, third-party platform limitations, network outages, force majeure events, or causes beyond SocialTrack’s reasonable control.
10. Intellectual Property
The SocialTrack platform, including software, interface, database, processing structure, workflows, designs, trademarks, logos, report templates, features, and related materials, is owned by SocialTrack JSC or its lawful licensors.
Customers and users may not copy, modify, distribute, resell, lease, create derivative works from, or exploit SocialTrack beyond the scope permitted in writing.
11. Confidentiality
During the use of the services, the parties may access each other’s confidential information, including but not limited to product information, business data, reports, pricing, technical materials, communication strategy, or customer information.
The parties are responsible for keeping such information confidential and using it only for the purpose of performing the services, unless otherwise agreed in writing or required by a competent authority.
12. Limitation of Liability
To the maximum extent permitted by law, SocialTrack shall not be liable for any indirect, incidental, special, consequential damages, loss of profits, loss of data, business interruption, or reputational damage arising from the use of or inability to use the services.
SocialTrack’s total liability for any claim related to the services shall not exceed the fees paid by the customer for the relevant service scope, unless otherwise required by law or contract.
13. Suspension and Termination
SocialTrack may suspend or terminate access to the services if a customer or user violates these Terms, fails to make payment on time, creates legal or security risks, or misuses the platform.
Upon termination, access to the platform will end. Certain provisions will continue to apply, including payment obligations, confidentiality, intellectual property rights, limitation of liability, and surviving obligations under the contract.
14. Governing Law and Dispute Resolution
These Terms of Service are governed by the laws of Vietnam.
Any dispute arising in connection with the use of the services shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation, it shall be handled according to the mechanism specified in the contract between SocialTrack and the customer, or by a competent authority in Vietnam in accordance with applicable law.
15. Changes to These Terms
SocialTrack may update these Terms of Service from time to time. The updated version will be posted on this page with the latest updated date.
Your continued use of SocialTrack after the Terms of Service are updated means that you agree to the revised Terms.
